VS Tennis Academy LLC Participant Contract, Liability Waiver, Photo Release Agreement, and Medical Release Form

Applicable to the State of Florida

This Agreement is effective upon purchase between VS Tennis Academy LLC ("Academy") and the undersigned individual and/or their minor child(ren) ("Participant"). By purchasing Academy services, the Participant agrees to these terms, governed by Florida law.

1. Services Provided

VS Tennis Academy LLC offers professional tennis lessons, camps, and training sessions. Services may include group and private lessons, clinics, and other tennis-related programs.

2. Terms of Service

Single Sessions: Individual sessions must be used within 30 days of purchase.
Packages: Lesson packages must be completed within 30 days of purchase. Unused sessions will expire without refund or carryover.
Rescheduling and Cancellation: Sessions may be rescheduled with at least 24 hours’ notice. Private lessons canceled within 24 hours are non-refundable and result in forfeiture of the session.

3. Agreement to Terms by Purchase

Purchasing services from VS Tennis Academy LLC confirms that the Participant has read, understood, and accepted this Agreement as a binding legal contract.

4. Waiver of Liability

4.1 Assumption of Risk
Participation in Academy activities involves inherent risks, including injury, illness, or death. The Participant voluntarily assumes all such risks.

4.2 Waiver of Liability
To the fullest extent allowed by Florida law, the Participant releases VS Tennis Academy LLC, its owners, employees, and affiliates from any liability for injuries, accidents, illnesses, or damages arising from participation, except in cases of gross negligence or intentional misconduct.

4.3 Risks Involving Minors
This waiver may not apply to claims arising from gross negligence or willful misconduct, particularly when minor children are involved.

5. Medical Release and Authorization

The Participant authorizes VS Tennis Academy LLC to:

Seek emergency medical treatment in case of injury or illness during activities.
Release relevant medical information as necessary for emergency care.
The Participant accepts responsibility for any medical expenses incurred.

6. Photo and Video Release

The Participant grants permission for photos and videos taken during Academy activities to be used for promotional purposes. To opt out, the Participant must notify VS Tennis Academy LLC in writing.

7. Code of Conduct

Participants are expected to demonstrate respect and sportsmanship. The Academy reserves the right to remove individuals for inappropriate behavior, with no refund for unused sessions.

8. Refund Policy

No refunds are issued for unused or expired sessions. In exceptional cases, refunds or credits may be offered at VS Tennis Academy LLC’s discretion.

9. Florida Consumer Protection

This Agreement complies with Florida consumer protection laws, including the Florida Deceptive and Unfair Trade Practices Act.

10. Governing Law

This Agreement is governed by Florida law.

11. Entire Agreement

This Agreement represents the entire understanding between the parties, replacing any prior agreements.

12. Severability

If any provision is found invalid, the remaining terms shall remain effective.

By purchasing, the Participant agrees to all terms and conditions, including the liability waiver, medical release, and photo release.
